The Regulations affect any person intending to carry out a construction project with an estimated cost greater than £300,000 and requires that person to prepare a Site Waste Management Plan (SWMP) before construction work can begin. There is additional information required in the SWMP for projects worth more than £500,000.
Seasoned developers will recognise the parallels with the CDM regime.
The penalty for failing to prepare and keep a SWMP is potential criminal liability and an unlimited fine. Where it is a company which carried out the offence, but it is proved that this was with the consent, connivance or neglect of a company officer (or manager) then that individual officer of manager will also be guilty of an offence.
Helpfully, the Waste Resource Action Programme (WRAP) has produced a free SWMP template, though this will no doubt be improved upon.
