Legacy Disputes
The Legacy Disputes Team comprises both specialist charity lawyers and litigators, providing comprehensive and sensitive advice on all kinds of legacy disputes. This includes claims under The Inheritance (Provision for Family and Dependents) Act 1975, negligent Will drafting, the ability to refuse a legacy, legacy mis-descriptions, charitable Will trusts where a Scheme is required, transfer of property to a charity in return for future benefits, Deeds of Variation, obtaining of comfort orders from the Charity Commission for trustees to pursue litigation and use charity funds to pay costs, as well as many other issues.
We can also advise you on acting as executor/administrator and obtaining trust corporation status to facilitate administering estates and other legacy matters. This can often avoid disputes in the first place, and keeps you in the driving seat in charitable estates.
