Legacy Disputes

Occasionally disputes arise concerning wills and estates.

The sort of disputes that might arise include -

• Actions to rectify a will.
• Disputes over the validity of a will, including claims of invalid execution, lack of mental capacity to make the will, or undue influence.
• Actions to replace executors.
• Actions to force executors to carry out their duties.
• Claims by creditors of the deceased.
• Claims arising from action or lack of action on the part of the deceased.
• Disputes about the disposal of assets in the estate.
• Disputes about the distribution of the estate.

We have wide experience of acting for all possible parties in making or defending claims. We act for executors as well as for beneficiaries or disappointed beneficiaries.

We have particular experience of advising charities and their legacy teams on legacy disputes.

We work closely with our colleagues in the Dispute Resolution Unit on claims that can arise. Paul Sutton, a member of that unit, is a particularly experienced solicitor dealing with legacy disputes.He is a member of the Association of Contentious Probate Practitioners.
