Receivers and Deputies - Court of Protection

If someone loses the capacity to manage their affairs and they have not made a valid Lasting or Enduring Power of Attorney it might be necessary to apply to the Court of Protection to obtain authority to deal with the incapacitated person’s affairs.  We can advise on applications to the Court of Protection to appoint a deputy to ensure that their affairs are looked after and decisions can be made on their behalf.  We can provide further advice on a deputy’s duties and annual compliance obligations.

Partners of the firm have extensive experience of acting as receivers and deputies. 

We can also help with other applications to the Court of Protection.  For example to make a Will for someone who lacks capacity or to ask the Court to approve lifetime gifts as part of an inheritance tax planning scheme.
