Do I Have A Claim?
Of the claims that are made each year, it is estimated that between 85% and 90% are totally or at least partially successful. However, the overall percentage of injured people who actually recover compensation for accidents is very low. It has been reported that only about 10% of accidents at work, and 25% of accidents on the road, actually result in a claim.
Therefore in the majority of cases innocent victims do not claim their rightful compensation. This is despite the popular myth that we are living in a 'compensation culture'.

Any claim for personal injury or death must be instituted within 3 years of the date of the accident. In the case of children and young people under the age of 18, this 3 year period runs from his or her 18th birthday. For example, if a child suffers an injury at the age of 10, they would have until their 21st birthday to institute a claim, by which we mean the issue of formal proceedings. There are certain circumstances when a 2 year period applies, for example in respect of claims being pursued under the Criminal Injuries Compensation Authority Scheme. Different periods also apply to accidents that occur outside the jurisdiction of England and Wales.
There are also instances where the deadline can be extended, such as when knowledge that an injury has been caused comes to light many years later, as in the case for example of a wrong diagnosis, or exposure to asbestos.
