How Much Will My Claim Be Worth?
Personal injury claims are made up of two separate elements, namely general damages and special damages.
General damages means the compensation for the actual injuries sustained as a result of the accident, to include any effects on your life, for example the effect on any hobbies or lifestyle. General damage awards are based on the expert medical evidence that we will obtain in support of your claim. Once we have a settled medical opinion and prognosis we will advise you as to the likely level of general damages. To make this assessment we have access to thousands of cases that have previously been decided by the courts. We also have access to a publication called the Judicial Studies Board Guidelines, which sets out guidelines at to the amount that is likely to be awarded, depending on the injury sustained.
Special damages are the financial losses arising from the accident and the injuries sustained. These are quantifiable financial losses. Common examples are loss of earnings, damage to property, medication costs, travel expenses and also the cost of third party assistance. Documentary evidence in support is required as evidence for these claims, and you would be able to assist by keeping hold of all documentation in support of the financial losses incurred.
