Probate and Estates
Helping you at times of lossComing to terms with the death of a loved one can be a very difficult and stressful time for all of us. Whether you are an executor named in a will or someone close to you has died without making their wishes known, we can help. Our experienced team of paralegals, probate solicitors and partners are here to advise you on all aspects of administering an estate, no matter how large or small. We can guide you through each step of the process and provide you with as much or as little assistance as you need. Our probate and estates team can help you with the following:
- advice about the necessary legal steps to administer an estate.
- obtaining details of and valuations for the deceased’s assets and liabilities.
- preparing the application for formal authority to deal with an estate (known as a ‘grant of probate’ where there is a will or ‘letters of administration’ where there is no will.
- advice about inheritance tax planning, assisting with the completion of the inheritance tax return and calculating the inheritance tax due.
- finalising the deceased’s income tax position and dealing with HM Revenue & Customs.
- dealing with the transfer or sale of assets.
- advice and assistance with regards to the deceased’s personal belongings and property.
- advice about any potential claims against the estate or disputes relating to the administration.
Our dedicated team of probate lawyers can also offer advice and assistance with more practical matters, for example:
-
registering a death.
-
arranging the funeral in line with the deceased’s last wishes.
-
attending nursing or residential homes to collect relevant paperwork.
-
contacting an insurance company to notify of death and arranging unoccupied house insurance cover.
-
notifying pension services, utility companies, banks and building societies.
Our charges are based only on the time we spend dealing with a matter and not a percentage of the value of the estate. We provide a clear cost estimate at the start of each matter and will regularly update you as regards to costs throughout the matter so you are kept fully informed.
