The ‘trust’ is generally regarded as one of English law’s greatest contributions to legal thinking and practice.
Trusts occur in many different situations.
Many are created deliberately, for example where assets are given to certain individuals (trustees) to look after on behalf of certain individuals (beneficiaries).
Trusts can also arise by operation of law (for example the trusts which can arise for spouses and infant children under the intestacy rules). And trusts can also be imposed by the courts (for example in family disputes).
