A new public authority, the Fair Work Agency, will be established. It will bring together existing enforcement functions such as for minimum wage, statutory sick pay and modern slavery. It will have strong investigative and enforcement powers, including enforcing failure to pay statutory payments to employees (including holiday and sick pay), issuing financial penalties and entering premises to inspect records. It will be able to bring employment tribunal proceedings on behalf of a worker.

It is anticipated that the Fair Work Agency will be established in April 2026, although it is not yet clear when the enforcement powers will take effect.
