A new public authority, the Fair Work Agency (FWA), was established on 7 April 2026.
It brings together existing enforcement functions of HMRC, Employment Agency Standards Inspectorate and the Gangmasters and Labour Abuse Authority. The FWA has powers to investigate breaches, issue civil penalties and take action against labour exploitation. Over time, it will take on enforcement of a wider range of employment rights including failures to pay statutory payments such as holiday and sick pay.
The FWA will have the power to issue financial penalties and enter premises to inspect records. It will be able to bring employment tribunal proceedings on behalf of a worker.
