On 26 January 2022 probate application fees in England and Wales increased to £273 for both professional and personal applications. Previously fees were set at £155 for professional applications and a higher fee of £215 for non-professional applications, to compensate for the fact that personal applications historically created extra administration work.

The Ministry of Justice has introduced changes to the probate fees as it believes that the difference in fees between professional and personal applications is unjustified. It remains to be seen whether the change in fees will result in more people taking the ‘DIY’ approach to probate applications without seeking professional advice. We will also have to wait to see whether the increased fee will result in any improvement to the current probate service offered by HMCTS and a reduction in turnaround times for the issuing of grants.
