Academies should take care in their response to ESFA letter about £100,000 salaries for ‘non-teaching’ staff

Stone King is aware that a number of academies have recently received a letter from the Education and Skills Funding Agency (ESFA) regarding salaries for employees in the Trust that are in excess of £100,000, in particular those whom the ESFA regard as “non-teaching”. The ESFA appears to consider that non-teaching staff spend 25% or less of their time teaching. It is important that in responding to the ESFA’s letter, Trusts take care in particular in relation to eligibility for the Teachers’ Pension Scheme. The issue of eligibility for members of staff who do not actually teach, such as many Headteachers and other members of the Senior Leadership Team, is complex. Appropriate advice should be sought before considering whether senior members of staff are eligible for TPS membership.
