James, an Associate Solicitor in Stone King’s Employment Team, told the news site that staff may be able to submit grievances but, in the extreme.

“Staff in the offices where no payments are received could allege there has been a fundamental breach of contract and resign, claiming constructive dismissal,” he said.

“There may (also) be an indirect sex discrimination risk if the office or other location, such as a warehouse, receiving the payment was predominantly female and those not receiving anything were predominantly male, or vice versa.”
