Partner Daniel Harris quoted in Third Sector article on mis-described Wills and charity beneficiaries

The Third Sector article, entitled ‘High Court decides destination of funds left to non-existent charities by former racing driver, looks at the additional clarity a high court judgement gives to mis-described Wills.

The judgement follows beneficiaries being unable to allocate funds from a Will as the charities named don’t exist, with painstaking legal work needed to understand and decide on the testator’s actual intentions.

Daniel, Head of Stone King’s International and Cross-border Team and Charity Legacy Team, said: “Difficulty identifying the intended charity beneficiary is a far more common issue than you would imagine, so the additional guidance that has been provided by the court provides legal practitioners with better tools with which to be able to craft a just and equitable solution.”
