The Government’s revoking of a £95,000 cap, designed to limit payouts to departing public sector staff, has been covered by Schools Week.
The article examines what schools now need to be aware of, and quotes Stone King Partner Polly O’Malley.
Polly said there is currently no obligation on the employer to re-enter settlements, although schools should be aware they may be approached to do so.
She said: “Particularly where settlement agreements have been signed, this will form a binding contract which the employer is not compelled to revisit.
“There doesn’t currently appear to be any obligation on employers to proactively seek out those individuals but obviously schools will need to be aware that they might be approached.”
