Spanish Conveyancing

Our specialist International and Cross-Border team can assist with the purchase and sale of Spanish property situated anywhere in Spain. 

We work closely with Spanish lawyers (abogados) to project manage the transaction on your behalf.

We will explain the Spanish conveyancing procedure and timescales, what to expect generally, and project manage the process from start to finish, helping to take away the burden away from you.

This includes liaising with Spanish lawyers to review any documents that you are asked to sign at an early stage, including paperwork provided by estate agents. Such legally binding documents can contain unfamiliar and onerous terms, so it is important to obtain advice before agreeing to them.

Our conveyancing service includes

  • Preparing powers of attorney (poderes) to enable Spanish lawyers to sign documents and attend meetings on your behalf, if needed.
  • Carrying out legal checks on the property (checking Registro de la propiedad entry known as nota simple).
  • Helping you to understand the costs of any taxes due on sale before agreeing to a sale price, including local plusvalia  tax and obligatory 3% capital gains tax retention payable to central government (impuesto sobre ganancia de capital).
  • If buying, helping you to understand what preparations you need to make, such as obtaining a foreigner’s identification number (NIE), and opening a Spanish bank account.
  • Applying for a NIE on your behalf under a power of attorney, if needed.
  • Negotiating the terms of sale or purchase.
  • Drafting and agreeing the sale contract (contrato de arras or contrato de compraventa).
  • Drafting and agreeing the transfer deed (escritura de compraventa).
  • Preparing for completion at the Notary’s office.
  • Our Spanish lawyers or their local agents can attend completion at the Notary’s office with you or on your behalf.
  • Dealing with post completion matters, including (if necessary);
    • Paying taxes;
    • Registering the property in your name at the Land Registry (Registro de la propiedad)
    • Updating ownership records with the community of owners (comunidad de propietarios) and town hall (ayuntamiento).
