The Department for Business and Trade has confirmed it has removed an example (Ian) it used in the Holiday pay and entitlement reforms, non-statutory guidance published on 1 January 2024, in response to a letter from Stone King.
Our view was that the example was incorrect, and we are pleased that the department considered our letter and it has now been removed.
The example of Ian could be interpreted to indicate that because TTO staff are paid in 12-monthly instalments, they would not be considered part-year workers.
Our view was that the example was incorrect, and we are pleased that the department considered our letter and has decided to remove Ian from the examples.
This is good news for schools and colleges employing term-time only staff in particular. For further information on this holiday pay and entitlement, please see our guidance note.
