Stone King’s Transport Team has successfully overturned the decision of the Traffic Commissioner for client Abus LTD.

The independent bus company is now entitled to employ drivers through another company, something which the Traffic Commissioner had said was unlawful.

However, Stone King established that previous cases demonstrated such an arrangement was allowable under Section 81 (1) (b) (ii) of the Passenger Vehicle Act 1981.

Judge Marion Caldwell QC said that case law established that contracting employees was legal in that Abus LTD had control of the drivers.
